Valuation under Compulsory Acquisition & Compensation
Article 20 of the 1992 constitution of Ghana guarantees prompt, fair and adequate compensation to property owners in the event of compulsory acquisition by the state. The Land Act, 2020 (Act 1036) provides for property owners affected by compulsory acquisition to submit particulars of their claim stating the nature of their interest, the manner in which the interest has been affected and the basis for the amount claimed as compensation for the loss of their property. Similarly, the Minerals and Mining Law (Compensation and Resettlement) Regulations, 2012 (L.I 2175) gives affected owners the right to appoint a qualified person who either submits their claim for compensation to the holder of the mineral right or must be part of negotiation committee to represent the affected claimants.
